Mitrovica - Ministry of Local Government, through a letter addressed to the Mayor of Mitrovica and the Speaker of Assembly, has annulled as legally groundless two decisions of the Municipal Assembly of Mitrovica, by which the inhabitants of Mitrovica were conditioned to pay water and garbage bills if they wanted to be provided any municipal service.

MLG has asked the annulment of the decision on conditioning of the inhabitants of Mitrovica to be provided municipal services only after they present the water and waste bills.  In the letter sent to  the Mayor and Speaker of the Municipal Assembly, among other things is said that restrictions on the provision of services to the citizens by performing their obligations to municipal utility companies has no legal ground and as such cannot be applied.

This is based on Article 128 of Law no. 02/L-123 for commercial companies and public utilities law no. 03/L-087, having determined that the joint stock company is responsible for all debts and other obligations with all its assets and property and that no one is responsible for the liabilities of the company just because it is shareholder in the company. 

In the letter among other things is said that based on the above mentioned provisions, the decisions of MA are inconsistent with the applicable legislation of the Republic of Kosovo. 
On this occasion the Ministry of Local Government requires the Mayor and Municipal Assembly, that their decisions to be promulgated in accordance with applicable legislation of the Republic of Kosovo, pledging their commitment to providing assistance to municipalities in full implementation of obligations arising from legislation. 

Officials of the Municipality of Mitrovica claim to have received a letter from the MLG and they are willing to enforce the law.
"We have received a letter and the Municipality will enforce the law strictly," Ahmet Jashari, the spokesman of the municipality, said. 

On the other hand the managers of the Water Company and the Waste Management Company have stated that there will be reductions in services to their citizens if the MLG rejects the MA decisions.
After ascertaining of MLG that the decisions are legally groundless, director of the Regional Water Company, Faruk Hajrizi, said he expects the decision of the Municipality on this issue and then he will decide on his own what to do, but he will not allow the water be spent in vain.

Even the manager of the Regional Waste Management Company “UNITETI” in Mitrovica, Skender Tahiraj, though he had considered very positive the decision of the Municipal Assembly of Mitrovica, regarding the conditioning of citizens, said there will be reductions in services but not to detriment of those who pay off the debts to the company. .
